Nirbhaya may rest in peace; Death sentence for all 4

The verdict of the horrific Delhi gang-rape case is out: All 4 of the accused tried as 'majors' have been handed the Death Penalty. As the reader is aware, the Nirbhaya rape case had rocked the conscience of an entire nation, and had called for strict action against rapists

The unfortunate death of the victim due to the horrific injuries inflicted upon her, strengthened the case for the death penalty. Though one of perpetrators (arguably the most brutal one) was able to escape due to the separate laws for 'minors', the other four found no such luck. The trial court described the crime as 'brutal', 'premeditated' and 'cold-blooded', thereby strengthening the case for the death penalty - which is to be used in the rarest of the rare cases.

A senior advocate Ramesh Gupta has been quoted as follows: "What is a rarest of rare case? If death for a crime is prescribed in the statute book when can it be awarded? The distinguishing feature is brutality of the crime that caused unbearable pain to a victim. In this case there is no doubt the victim was subjected to horrific torture and brutality that led to her death. In my view, for sheer brutality it qualifies to be a case fit for death penalty".

The verdict has evoked strong emotions among a justice starved nation that has been eagerly waiting for the past 9 months for the verdict. "Finally one can get a feeling of some peace knowing that at least in this particular instance, justice has been served. There is definitely no doubt that the courts bowed to public pressure and were thus encouraged to give the just verdict. I hope this case changes the way brutal crimes are looked at and more stringent punishments are put in place.", says Antara Ahluwalia, a 2nd year Commerce student.

"Definitely the only just verdict possible, I am very glad that the death penalty was awarded. I can only hope that this serves as a deterrance to all criminals", says Arohi Singh, a 3rd year English honours student.

"This case definitely shook up the public and made them question themselves. Could we allow such crimes to occur in society around us? The answer is a resounding NO. It is important for our society to keep up the pressure on the police and judicial system to ensure that all crimes, large or small, don't go unpunished", says Siddharth Malhotra, a 2nd year economics student who had actively participated in the protests in December 2012.

Justice has been served in the Nirbhaya case, despite the unfortunate fact that the minor escaped severe punishment. One hopes that all crimes against women are dealt with swiftly and severely.
